Terms & Conditions

By accessing this website, making a booking, paying a deposit, or engaging the services of Kim Power Photography, you acknowledge that you have read, understood, and agree to be bound by all terms, conditions, and policies outlined on this website. This agreement forms a legally binding contract between you (the client) and Kim Power Photography from the time a booking or payment is made. If you do not agree to these terms, you should not proceed with any booking or payment through this website.

(1) Deposits are due in advance, are non-refundable and payment for travel over 100km is due in advance.

 

(2) If a wedding is postponed, the credit paid can be used for up to 3 years.

 

(3) All images are copyrighted by Kim Power Photography, even those you purchase. Images purchased may not be re-edited, filtered or altered in any way. I do not give out any un-edited images to any client.

(4) Copying, screenshotting images in your online gallery is strictly prohibited. Print-screening images from this website, or the online gallery is also against the law.  All offenders will be prosecuted accordingly.  Online wedding galleries will be online for 3 months, portrait for 30 days, unless a client has no access to log in during that time.  A reupload fee of $15 applies for galleries once they have been removed if they are to be uploaded a second time.

 

(5) Prices are subject to change without notice and are non-negotiable.  Prices are guaranteed for 30 days.  Due to the custom nature of photographic products, no refunds will be issued.

 

(6) Clients are not permitted to use their own cameras at the photography session. This includes the use of iPhone, android cameras.

(7) Clients will not disparage Kim Power Photography online or orally, post any incorrect/false statements, reviews, comments. Statements that are false, exaggerated, or misleading may constitute defamation under Australian law. Parties agree that it would be impracticable and extremely difficult to ascertain the amount of actual damages caused by a failure to comply with this provision. False or malicious publications may result in immediate legal action without further notice.

(8) The client has 7 days after receiving their photos to negotiate any issues or changes, this is non-negotiable.

(9) No part of any order, including digital images, will be delivered until the package balance has been paid in full.

​

(10) Minimum 6 months notice must be given to offer a full refund for a wedding package.​​
